The Ohio Supreme Court provided a ray of sunshine as we began 2013. In a stunning decision, long supported by the MIRA, the Ohio Supreme Court issued an opinion finding the Ohio CAT on motor fuel “Unconstitutional” on grounds that the tax is required to build and repair streets, highways and bridges, and NOT be applied to the Ohio general fund. The Court remanded this tax issue back to the lower court-for directions to the legislature in curing the defective CAT on motor fuel. Now-the door is wide open to bring the motor fuel tax to the “rack” as the legislature is required to make changes consistent with the Court’s ruling. Meetings with the Governor, House Speaker and Senate leaders will take place in March. Moreover, leveling the playing field on motor fuel taxation for our members appears a reality. This ray of light from the Supreme Court couldn’t have come at a better time! We will update our membership at every opportunity.
